Draft for Osmia, LLC post-formation launch. Until Osmia, LLC is fully approved and ready for public use, these terms should be treated as a pre-release legal draft for private testing and transition planning.
These terms govern your use of the Mastery Monitor website and software ("the app"). By using the website, installing, launching, activating, or otherwise using the app, you agree to these terms. Please read them alongside our Privacy Policy.
Mastery Monitor is developed and provided by Osmia, LLC.
Beta software
Mastery Monitor may be offered as beta software for testing and evaluation. Beta builds may contain bugs, errors, incomplete features, and user interface or behavior changes. Features, behavior, licensing, and availability may change before public release.
Mastery Monitor is not intended to serve as your sole or official record-keeping system for grading, evaluation, reporting, or any purpose where data integrity is critical. Users should keep official records and backups outside the app.
Local data and student information
Mastery Monitor is designed as a local-first desktop application. Classroom, roster, score, assignment, standards-tracking, intervention, and similar teacher-entered records are stored locally on the user's device.
Mastery Monitor does not transmit student names, rosters, scores, assignments, standards progress, intervention records, or other classroom records to Osmia, LLC as part of normal app use.
Users are responsible for securing their devices, local database files, exports, and backups, and for following school, district, employer, FERPA, and other applicable privacy requirements.
Limited internet features
Mastery Monitor may connect to the internet for license activation, license status checks, offline activation support, version checks, and update availability notices.
These requests may include license information, activation status, app version, device or installation identifiers, timestamps, IP address, and basic technical information needed to operate licensing and update services. These features are not intended to transmit student/classroom records to Osmia, LLC.
Crash logs and support materials
Mastery Monitor may generate local diagnostic or crash logs on the user's device. Crash logs are not automatically transmitted to Osmia, LLC.
Users may choose to download, review, redact, and voluntarily send logs, screenshots, sample files, or other support materials for troubleshooting. Users are responsible for reviewing materials before sending them and for removing student personally identifiable information unless authorized to share it.
License restrictions
Each license key is for the authorized user and devices allowed by the license type. Users may not share license keys with unauthorized users, resell or sublicense keys, reverse engineer the software, circumvent activation or access controls, or redistribute the software without written permission from Osmia, LLC.
Future purchases
Mastery Monitor is expected to transition from beta access to a paid license model. Pricing, license tiers, renewal terms, refund rules, and cancellation terms will be provided before paid access begins. Purchases made through third-party platforms are also subject to those platforms' terms.
No warranty
Mastery Monitor is provided “as is,” without warranties of any kind, express or implied. Osmia, LLC does not guarantee accuracy, reliability, uninterrupted operation, fitness for a particular purpose, or the absence of bugs, data corruption, unexpected behavior, or data loss.
Limitation of liability
To the fullest extent permitted by law, Osmia, LLC is not liable for damages arising from use of, or inability to use, Mastery Monitor, including loss of data, data corruption, missed deadlines, reporting issues, employment-related consequences, or indirect, incidental, special, consequential, or punitive damages. Because classroom data is stored locally, users are responsible for backing it up.
Updates and termination
Osmia, LLC may release updates at any time. Updates may add, modify, or remove features and may revise these terms. Continued use after updates or revised terms are presented constitutes acceptance.
Osmia, LLC may revoke or terminate a license if a user violates the agreement. Upon termination, the user must stop using the software and delete unauthorized copies. Local data remains the user's responsibility.
Trademarks & attribution
NGSS* and Next Generation Science Standards* are registered trademarks of WestEd. Neither WestEd nor the lead states and partners that developed the Next Generation Science Standards were involved in the production of this product, and do not endorse it.

Mastery Monitor may support importing data from or working with export files from third-party educational platforms, including Google Classroom™, Canvas LMS, Skyward®, and PowerSchool®. References to these platforms are provided only to describe compatibility and supported workflows. Mastery Monitor is independently developed and is not affiliated with, endorsed by, sponsored by, certified by, or officially connected to Google LLC, Instructure, Inc., Skyward, Inc., or PowerSchool Group LLC, or their affiliates.

Governing law
These terms are governed by the laws of the State of Washington, United States of America, without regard to conflict of law provisions.
Changes
We may update these terms as the product evolves. We'll update the date at the top when we do.
